MN Supreme Court Issues Ruling Concerning Carter Hotel Dispute


Duluth, MN (KDAL) - The Minnesota Supreme Court has removed itself from the fight over the fate of the Carter Hotel.  The Fond du Lac Band of Lake Superior Chippewa is seeking to place the property in downtown Duluth into trust.  The city has maintained through legal challenges that the move violates a 1986 agreement between both sides.  By placing the property into trust, City Attorney Gunnar Johnson says the city would have little say on how the land is used.  On Wednesday Justices wrote in their opinion that the state cannot intervene, other than to say which court can determine the matter, because the tribe consented to be sued only in federal court.  Johnson tells K-D-A-L News he doesn’t consider the ruling a set-back.  Rather he says the city has been given direction on which court system should ultimately decide the matter, adding that the city will continue its fight.  He would not comment on what steps they will take next.
