UNDATED (KDAL) - A judge has thrown out a lawsuit brought by Minnesota, Wisconsin and 3 other states that called for permanent barriers in Chicago to keep Asian Carp out of Lake Michigan. Judge John Thorp says federal law requires that shipping channels remain open and that new dams are prohibited. The judge says creating such barriers would need to go through Congress or other court action such as a nuisance claim.
